No.
Vitakka and Vicara (say fabrication of thoughts) stop at second Jhana.
The aim of Buddhism is to eliminate suffering permanently.

Every living being have a path knowingly or unknowingly.
That is why Buddhist teaching is called Noble Path.
The path of the Nobles.
Which means that there is a path of Ignobles as well.

However, what is crucial here is the Upadana.
In my opinion, Buddha also had Nama-rupa without clinging (upadana)

There's little doubt that in AN 2.23 "misrepresent" ( as used by Bhikkhus Bodhi and Sujāto) is the intended meaning.
slander = make false and damaging statements about (someone).

So transmitting wrong Dhamma is misrepresentation with knowingly or unknowingly?

The way I understand that slandering the Buddha means telling some thin as if Buddha said. For example, fake Buddha quotes.
As we do not have a living Buddha now I think we have to accept the Tipitaka as the words of the living Buddha.
So whatever we say must be able to support Tipitaka.
