Who owns the temple?

Who owns the temple?
It appears most of the court cases in Sri Lanka are about the ownership of the temple and the appointment of the head monk upon the deceased of the former head monk.
Is there any help from Vinaya or Tipitak in this regard?

Jesus does.

More seriously, which temple do you mean?
What is the Uncreated?
Sublime & free, what is that obscured Eternity?
It is the Undying, the Bright, the Isle.
It is an Ocean, a Secret: Reality.
Both life and oblivion, it is Nirvāṇa.

At this stage, we will discuss only the OP. ;)
I like to be more generic than specific for now.

In the U.S., it is the Sangha or community that owns the temple, not any specific person. A charitable organization is set-up, typically tax-exempt so doesn't pay any property or other taxes. The charitable organization is the owner and there is a Board of Directors of about 5 to 10 people who make those decisions regarding the temple and successors, new residents, etc. At least one member of the Board is a lay person who acts as the Treasurer, receiving the funds and paying utilities and other bills.

I assume it's a similar situation in other countries too.

Yes, that's the way most of these organisations work here in New Zealand, and I think Australia and the UK. A charitable trust owns the property, etc, and donations to the trust are tax-deductible.
